Bessent Just Gave 18000 Private Schools In America One Ultimatum Over DEI

Sep 7, 2026

Harvard spent two years fighting Trump over its tax exempt status.

Now Bessent and the IRS just aimed that same weapon at every private school in the country.

Eighteen thousand schools just got one ultimatum they cannot ignore.

Treasury And IRS Rule Would Strip Tax-Exempt Status From Schools Using DEI

The Trump administration is done letting schools hide race based discrimination behind nicer words.

On Thursday, the Treasury Department and the IRS proposed a rule that strips federal tax exempt status from any private school that uses race in admissions, scholarships, financial aid, athletics, or any other school run program.

Treasury Secretary Scott Bessent did not soften the message.

"Schools rebranding race-based preferences as equitable, inclusive, or diversity-enhancing does not change their discriminatory nature," Bessent said.

That line is the whole ballgame.

For years, universities dropped the term "affirmative action" and started calling the exact same racial preferences "equity" and "inclusion."

Bessent just told them the rebrand is over.

IRS Chief Executive Officer Frank Bisignano put it even more bluntly, warning schools that keep the practices going "should expect to lose that status."

This is not a symbolic warning shot.

What Losing Tax-Exempt Status Actually Costs A School

Treasury estimates the rule could touch as many as 18,000 elementary schools, high schools, colleges, universities, and trade schools.

It covers admissions decisions, it covers scholarships and loans, it covers athletics, and it covers "every other school-administered or school-supported program."

If a school considers race for any reason, including so-called remedial reasons, the tax break disappears.

Losing that tax exemption is not a slap on the wrist, it is a financial gut punch.

Alumni donations stop being tax deductible overnight, so the checks get smaller or stop coming.

The school starts paying taxes on its endowment gains like any other business, not like a charity.

Tuition goes up to cover the difference, and the students who never asked for any of this get the bill.

Schools that spent a decade bragging about their diversity offices are about to find out those offices were never free.

The Bob Jones Precedent Behind Trump's Tax-Exempt Crackdown

This is not the first time an administration has used tax exempt status as leverage on racial policy.

Back in 1983, the Supreme Court upheld the IRS stripping Bob Jones University of its tax exemption over racially discriminatory rules, and the Trump administration is now leaning on that same precedent.

Wisconsin's Supreme Court already killed a state run, race restricted scholarship program earlier this year, ruling the state cannot hand out taxpayer money based on skin color.

Duke ended a full ride scholarship program for select Black students rather than risk a lawsuit.

Missouri's flagship university killed its own race based Diversity Award after the state attorney general said the Supreme Court's ruling left no other option.

The pattern is obvious.

Every time a court or a regulator forces the issue, race based programs cave immediately, because they were never built on solid legal ground, they were built on political nerve.

Take away the nerve and the whole thing folds in a matter of weeks.

AAUP Calls IRS Crackdown On Race-Based Admissions Racist, Vows Lawsuit

Here is where it gets rich.

The American Association of University Professors is already vowing to fight the rule in court.

AAUP President Todd Wolfson did not call the rule discriminatory.

He called it "blatantly racist political coercion."

Read that again.

A rule that says schools cannot treat students differently because of their race is, according to Wolfson, itself racist.

Wolfson argued the rule is "intended to deny minority students reparative opportunities to further their education."

Translation: he wants race to keep counting, as long as it counts in the direction he prefers.

That is not equal protection under the law, that is picking winners by skin color and calling it justice.

The Supreme Court already settled this argument in 2023, when it struck down race conscious admissions and ruled that applicants must be judged as individuals, not as members of a racial category.

Universities spent the two years since that ruling looking for workarounds, quietly folding race back into "holistic review" and rebranded diversity offices.

Bessent's proposal closes that loophole by tying the workaround directly to the money.

The Lawsuit Fight Over Trump's DEI Tax Rule Is Just Starting

Universities built entire departments around the assumption that race conscious policy was untouchable.

They bet wrong.

The moment the Supreme Court and now Treasury started pulling on that thread, the programs designed to look permanent started unraveling one school at a time, from Wisconsin to Duke to Missouri.

This rule turns that unraveling into a nationwide standard instead of a state by state fight, and it puts every college president's fundraising letterhead – along with its tax bill – on the line.

Expect a lawsuit from AAUP within weeks.

Expect Ivy League lawyers to argue that "holistic" review is somehow different from a quota, with a straight face.

Expect Treasury to argue right back that a discriminatory practice dressed up in softer language is still a discriminatory practice, and that the bill is coming due either way.

The schools that spent a decade lecturing this country about equity just got handed the invoice for practicing the opposite of it, and this time they cannot write it off.
